TERMS AND CONDITIONS

Please read these Terms carefully and make sure that You understand them, before ordering any Products. Please note that before placing an order you will be asked to agree to these Terms.

Avenue Interiors – Wood flooring (as defined in the terms and conditions of sale as set out on www.avenue-interiors.com) warrants that the Products (as defined in the terms and conditions of sale as set out on www. avenue-interiors.com) you purchase from us will comply with their description, be of satisfactory quality, and be reasonably fit for all purposes which products of that kind are commonly supplied. This warranty is limited to the Products being used for their intended purpose and applied, installed and maintained strictly in line with the manufacturer’s instructions. This warranty is given to you only from the date of original purchase and is not transferable. Proof of Purchase is required to make a claim under this warranty. The warranty, in respect of Products purchased for non-commercial purposes in domestic/residential locations, lasts for 20 years as set out below. If you are contracting with us as a trader and purchase Products for commercial projects, the warranty set out below only applies for 12 months.

Wood is a natural product with natural color variations, grain variations, and tone variations. It is also the responsibility of the person installing the floor to de-select any faulty or damaged boards prior to the installation as no claims for faulty or damaged boards can be accepted after the installation.

Avenue Interiors warrants that its Products, in their original manufactured condition, will be free from structural defects for a period of 20 years.

You must ensure that the details of your order for the products are complete and accurate before you submit the order. If You think that there is a mistake, please contact us to discuss.

Any quotation for the products is valid for a period of 30 days only from the date that it is issued, provided that We have not previously withdrawn it. Quotes are subject to current stock availability from our suppliers.

If you place an order for a product and we are unable to supply it, for example because that Product is not in stock or no longer available, we will inform you of this by email or telephone and we will not process your order. If You have already paid for the products, we will refund you the full amount as soon as possible.

These Terms apply to all our sales and any variation to these Terms and any representations about the products shall have no effect unless expressly agreed in writing and signed by one of our authorised representatives.


DESCRIPTION & MATERIAL

The quantity and description of the Products shall be as set out in our quotation.

The images of the products are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours will accurately reflect the colour of the products. Your products may vary slightly from those images.

Although we have made every effort to be as accurate as possible, all sizes, weights, capacities, dimensions and measurements indicated in our literature or elsewhere are approximate

Due to the nature of the Wood Floor Products, we cannot guarantee:

(a) the moisture content of the Wood Floor Products which will vary from batch to batch; (b) the profiles of tongue and groove which will vary from batch to batch; (c) the colour and consistency of the Products, which may vary from any samples and change as a result of the passage of time.

In the event that we do not have the exact product we are entitled to supply an alternative product to match as closely as possible to the products that you have ordered. We will provide you with reasonable notice as soon as this becomes apparent and you will have the option to accept the alternate product or cancel your order.

You shall be responsible for ensuring that the Products are fully and properly maintained, by ensuring that the Wood Floor Products are adequately protected against damage (including but not limited to scratches, dents and scuff marks) including but not limited to by adequate protection underneath furniture and appropriate use of entrance door matting in accordance with manufacturer's guidance or instructions or guidance provided by the installer of the Wood Floor Products.


PERFORMANCE AND DELIVERY

We shall deliver the products to the address that you have provided us with in your order, or such other location as we shall agree in writing provided always that we are permitted to do so by law.

If you wish to collect the products from us, you must notify us of this upon placing your order or at least five working days before delivery date.

Delivery of the order shall be completed when we deliver the products to the delivery location or make the order available to you for collection and we shall use reasonable endeavours to deliver each of the orders for the Products by the estimated delivery date. We shall notify you of the date upon which we will deliver the products or make them available for collection by you by email or telephone prior to dispatch.

When we deliver the products at the Installation location. You must ensure that adequate assistance and personnel are available to unload and inspect the products upon delivery.

We shall have no liability for any failure or delay in delivering the order where:

(a) such failure or delay is caused by your failure to comply with your obligations under the Contract, including a failure to:

(i) collect the Products in accordance with the above and/or

(ii) to provide us with the correct delivery address or any other relevant instructions or provide assistance on delivery.

(b) the failure or delay has been caused by an Event Outside Our Control.

Once the products have been installed, they are deemed to be accepted. After acceptance you shall not be entitled to reject the products which are not in accordance with the Contract.

In event of termination under this contract We shall be entitled to be paid all outstanding sums in respect of products delivered to you as at the date of termination, together with any expenditure reasonably incurred by us in the expectation of the performance of or in consequence of the termination of the contract and loss of profit on the Contract including the difference between the total price to be paid on termination and the contract price. All outstanding sums in respect of products delivered to you shall become immediately due.

RISK & TITLE

You do not own the products until we have received payment in full (in cash or cleared funds) for the products and all other sums that are due to us from you.

The products will be your responsibility from the arrival of the products at the delivery location (for the avoidance of doubt, prior to unloading) or Deemed Delivery.

PRICE OF PRODUCTS AND DELIVERY CHARGES

Prices for our products may change from time to time, and we may, by giving notice to you at any time up to 5 Business Days before Delivery, increase the price of the product to reflect any increase in the cost of the products that is due to:

(a) any factor beyond our control including but not limited to:

(i) foreign exchange fluctuations; (ii) increases in taxes and duties; and (iii) increase in labour, material or other manufacturing costs;

(b) any request by you to change the Delivery Date, quantities or types of products ordered, or any specification.

(c) any delay caused by any of your instructions or your failure to provide us with adequate or accurate information or instructions.

The price of the products shall be exclusive of any value added tax ("VAT") and all costs or charges in relation to packaging, loading, unloading, carriage and insurance ("Additional Payments"), all of which amount you shall pay in addition when you are due to pay for the products.

The price of the Products does not include delivery charges. Our delivery charges will be quoted in advance.

PAYMENT

You can pay for the products in cash or by making a direct bank transfer into our account.

Payment for the product and all applicable delivery charges, additional payment and international payment must be made at the time you place your order for the products or paid in full prior to delivery or collection.

Where you are invoiced in accordance with payment terms, payment must be made in full.

WARRANTY

SOLID WOOD FLOORING

Hardwood flooring, being a natural hygroscopic product, will expand and contract through heating and non-heating seasons. During these seasons you may experience some separation between the boards. This is not a product defect and is not covered by this WARRANTY. Correct job site pre- inspection, installation and maintenance procedures must be followed. Failure caused by excessive expansion of the flooring, excessive subfloor moisture and/or water damage, including but not limited to, broken water pipes or flooding, are not covered under this WARRANTY.

ENGINEERED FLOORING

Avenue Interiors additionally warrant that all its engineered hardwood flooring Products will not delaminate, wear through or twisted. Correct job site pre-inspection, installation and maintenance procedures must be followed. Flooring or Ply-adhesive breakdown caused by excessive/inconsistent heat changes, excessive subfloor moisture and/or water damage, including but not limited to broken water pipes or flooding, are not covered under this WARRANTY.

Avenue Interiors LIABILITY

ALL PRODUCTS

If in the unlikely event that any portion of your Product should fail with respect to the provisions of these warranties, Avenue Interiors will repair, refinish, or replace such portion, at no cost to you using either the same wood, or a suitable alternative should the original wood no longer be stocked by us. In the unlikely event Avenue Interiors is unable to correct any portion of a defective Product after a reasonable number of attempts, Avenue Interiors will refund the purchase price for the portion of the Product that is defective pursuant to the terms of the delivery and returns policy.

This warranty does not cover any extra costs stemming from a defective Product, such as the removal of furniture, fixtures, electrical items or labour costs.

WARRANTY DISCLAIMERS

Avenue Interiors promises to investigate each complaint on individual merit. To be a valid breach of warranty the problem must be solely attributable to a manufacturing fault and the correct fitting instructions and maintenance of the boards must have been fully adhered to. In the unlikely event of instructions not being provided with a Product, copies should be requested from Avenue Interiors prior to installation. Where you are not installing the Product personally, a copy of the installation instructions must be provided to the fitter prior to installation.

Colour variations in flooring are a natural occurrence due to species, age, character of flooring and exposure to UV light or sunlight. For these reasons, new and/or replacement flooring may not match display samples and/or existing flooring.

Naturally occurring wood characteristics, such as variations in grain, colour, knots, mineral streaks, and sap wood are not considered defects.

The ultraviolet rays that can burn and age our skin will affect any organic material, including wood. Prolonged exposure to sunlight will change the colour of virtually any wood floor, regardless of the stain or finish. Some woods lighten when exposed to sunlight. Others, like cherry and oak, tend to darken. This is not a Product defect.

Your flooring requires maintenance. Please follow the instructions that are recommended by Avenue Interiors. The ingress of sand and or dust on to the floor should be prevented by installing a suitable mat by the entrance door(s).

The WARRANTY can only be invoked if the surface wear layer area damaged for each board is greater than 1 sq.cm. Lacquer / Oil / HPPC wear is not classed as surface damage as this represents additional protection and is subject to correct maintenance practices / periodic re-application.

Avenue Interiors reserves the right, and must be offered the opportunity to, inspect the problem in site and, where applicable, to inspect the floor in its installed condition.

The warranty, in respect of Products purchased for non-commercial purposes in domestic/residential locations, lasts for 20 years and is on a sliding scale. When it is applied, account must be taken of a fractional reduction in value caused by wear and tear of 1 part per year. i.e. a 20- year WARRANTY = 20 parts.

WARRANTY EXCLUSIONS

Any of the following shall void and invalidate our WARRANTY:

1. Damage due to moisture including, but not limited to, leaking pipes, incorrect maintenance, excessive moisture in subfloor or humidity, or similar damage caused by conditions that are too moist.

2. Damage of a mechanical nature, such as scratches (for example caused by dragging furniture over the floor) or surface damage caused by falling objects. We recommend protective felt pads are fitted to table and chair legs and that wheels and castors are housed inside felt backed holders

3. Moisture left on the floor, cleaning methods using excessive liquid and/or the use of inappropriate cleaning products.

4. Damage caused by settling or uneven subfloors.

5. Where installation is carried out by other parties: Incorrect installations, done in a way that is contrary to the instructions provided.

6. Improper maintenance or inadequate care.

7. Damage resulting from accidents or abuses that stain or scratch the finish of wood flooring, diminish gloss, or indent the surface of the wood.

8. Damage caused by heavy or concentrated foot traffic, pet's claws (nails), sand, gravel and other abrasives.

9. Walking on any Product with stiletto heels. This will cause indentations which are not covered by the WARRANTY. A stiletto heel can concentrate as much as 2,000 pounds per square inch on a floor.

10. Defects and damage caused by manmade or natural disasters including, but not limited to, leaking or broken plumbing, fire, flood, earthquake or standing water during or after construction.

Should you feel that you have to make a claim, please contact us as soon as the problem is noticed. A proof of purchase is necessary to process your claim quickly and efficiently.

Please Note: This warranty is in addition to and does not affect your statutory rights. Please keep this section in a safe place as it will be of benefit to you should you make a claim. Staple the receipt of purchase, a set of installation instructions for the Product and any receipt for installation works to this sheet, as this will act as proof of payment.
